1. Subject of the Policy
This Delivery and Return Policy has been prepared to set forth the terms and conditions governing the delivery, shipping, domestic and international shipment, right of withdrawal, return, and refund processes for orders placed through the website and Shopify-powered e-commerce store of the BRAGI FORSETI brand, operated by MODERNO TASARIM TEKSTİL SAN. VE TİC. LTD. ŞTİ.
This document shall be read and applied in conjunction with the Distance Sales Agreement, the Pre-Contractual Information Form, the Return / Exchange / Cancellation Policy, and all other legal texts published on the website.

3. Order Processing
Orders placed through the website shall be processed upon successful completion of the payment transaction.
Order processing times may vary depending on the stock availability of the product, order volume, the nature of the product, promotional periods, public holidays, weekends, and operational processes.
The estimated timeframe for order preparation and dispatch to the carrier may be separately indicated on the order screen, the product page, or in post-order notifications.
The Seller reserves the right to cancel the order and refund the amount collected in respect of products that are out of stock, cannot be procured, contain pricing or system errors, or cannot be shipped due to technical or operational reasons.
4. Delivery Address and Accuracy of Information
Orders shall be shipped to the delivery address specified by the Buyer at the time of placing the order.
The Buyer acknowledges and accepts that the delivery address, full name, telephone number, e-mail address, and billing information provided are accurate, complete, and up to date.
The Buyer shall be responsible for any consequences arising from the failure to deliver the product, delays in delivery, return of the shipment to the Seller, or any additional costs incurred due to incorrect, incomplete, or outdated delivery information.
In the event that the Buyer identifies an error in the delivery information after placing the order, the Buyer should contact the Seller without delay. Address changes may not always be possible once the order has been dispatched to the carrier.
5. Shipping and Delivery Process
Orders shall be delivered through the cargo or logistics companies with which the Seller has a contractual arrangement.
Information regarding the carrier, delivery method, tracking number, and delivery status may be communicated to the Buyer via e-mail, SMS, system notification, or through the website, depending on the status of the order.
Delivery times may vary depending on the delivery address, the carrier's operations, regional congestion, weather conditions, public holidays, promotional periods, customs procedures, international shipping processes, and force majeure events.
The Seller is obliged to prepare and dispatch the order to the carrier within a reasonable timeframe. The Seller shall not be held liable for delays attributable to the carrier, customs processes, or the Buyer.
6. Domestic Deliveries
For deliveries within Türkiye, products shall be shipped to the address specified by the Buyer at the time of placing the order.
Shipping fees, free shipping conditions, or delivery benefits offered as part of promotional campaigns may be separately indicated on the order screen or on the website.
Where the shipping fee is payable by the Buyer, this fee shall be displayed to the Buyer prior to the completion of the order.
In the event that the Buyer is not present at the delivery address, refuses to accept the delivery, or fails to collect the product from the carrier's branch within the designated period, the product may be returned to the Seller. Any additional shipping, re-dispatch, or other costs that may arise in such circumstances shall be subject to further assessment.
7. International Deliveries
BRAGI FORSETI may offer international sales through its website.
Delivery times for international shipments may vary depending on the destination country, the logistics provider, customs procedures, in-country distribution, import procedures, and local regulations.
For international orders, customs duties, import taxes, local taxes, levies, demurrage charges, processing fees, commissions, or similar additional costs may apply in addition to the product price and shipping fee. Unless expressly stated otherwise, such costs shall be borne by the Buyer.
The Buyer is responsible for reviewing the import, customs, tax, and delivery regulations applicable in the destination country for international deliveries.
In the event that the product cannot be delivered, is delayed, is returned, or additional costs arise due to customs requirements or local regulations in the destination country, the Seller's liability shall be assessed based on the specific circumstances of the case.
8. Inspection Upon Delivery
The Buyer is advised to inspect the shipping package upon receipt of the product.
In the event that the package shows signs of crushing, tearing, opening, water damage, damage, missing contents, or any other irregularity, the Buyer is advised to have the carrier prepare a damage report (tutanak) and to notify the Seller at the earliest opportunity.
A carrier damage report may be of significance in the assessment of claims relating to damaged or incomplete deliveries.
In respect of damage, deficiency, or defect claims identified after acceptance of the product, the Buyer is advised to contact the Seller without delay and to provide supporting documentation such as photographs, video recordings, carrier damage reports, or similar evidence.
9. Undelivered Orders
Orders may not be deliverable due to the Buyer's absence at the delivery address, incorrect or incomplete delivery information, the carrier's inability to reach the Buyer, the Buyer's failure to collect the product from the carrier's branch, or similar reasons.
In the event that undelivered orders are returned to the Seller, the Seller may contact the Buyer.
Decisions regarding re-shipment, cancellation, or refund of undelivered orders shall be assessed taking into account the nature of the order, the shipping process, the reasons attributable to the Buyer, the condition of the product, and the applicable legislation.
10. Returns Under the Right of Withdrawal
Subject to the exceptions prescribed by applicable legislation, the Buyer may exercise the right of withdrawal within 14 (fourteen) days from the date of receipt of the product, without providing any justification and without incurring any penalty.
In the case of sale of goods, the withdrawal period shall commence on the date the product is delivered to the Buyer or to a third party designated by the Buyer. Where multiple products forming part of a single order are delivered separately, the period shall commence on the date of delivery of the last product.
The consumer wishing to exercise the right of withdrawal must communicate this intention to the Seller by means of an unequivocal statement.
In accordance with the guidance published by the Ministry of Trade of the Republic of Türkiye, the consumer is entitled to exercise the right of withdrawal in distance contracts within 14 days without providing any justification and without incurring any penalty. Upon receipt of the withdrawal notification, the seller is obliged to refund the amount paid by the consumer within 14 days.
11. Condition of the Product to Be Returned
Products submitted for return under the right of withdrawal or a return request must:
- Be unused;
- Be undamaged;
- Be free from dirt, stains, and odours;
- Not be worn or deformed;
- Have all original tags and labels intact;
- Be in a condition suitable for resale;
- Be accompanied by the original box, packaging, accessories, tags, user documentation, and invoice, where applicable.
The Buyer shall only inspect the product in a manner consistent with ordinary examination and shall not use the product in any way that would diminish its value.
In the event that the product has been used, damaged, rendered incompatible with hygiene requirements, or has otherwise lost its suitability for resale, the return request may be rejected, or the product may be returned to the Buyer.
12. Exceptions to the Right of Withdrawal
Without prejudice to the exceptions prescribed by applicable legislation, the right of withdrawal may not be exercised in respect of the following products:
- Products prepared in accordance with the Buyer's specifications or clearly personalised to meet the Buyer's individual needs;
- Custom-made, personalised, or made-to-measure products;
- Products the packaging, seal, tape, or other protective elements of which have been opened following delivery, and the return of which is not appropriate on grounds of hygiene or health;
- Products that have been used, worn, soiled, stained, exposed to odours, damaged, had their tags removed, or have otherwise lost their suitability for resale;
- Products that, following delivery, have become inseparably mixed with other products;
- Products that are liable to deteriorate rapidly or expire;
- Other products and services designated as exceptions to the right of withdrawal under applicable legislation.
Return requests concerning BRAGI FORSETI products shall be assessed taking into account the nature of the product, its condition of use, hygiene requirements, the condition of its packaging and tags, and its suitability for resale.
13. Return Application and Return Procedure
The Buyer wishing to submit a return request must notify the Seller by means of an unequivocal statement within the 14-day withdrawal period.

Following the submission of the return request, the Buyer shall dispatch the product to the return address communicated by the Seller and in accordance with the return procedure specified by the Seller.
The consumer must return the product within the period prescribed by applicable legislation, commencing from the date on which the withdrawal notification is communicated. In accordance with the guidance published by the Ministry of Trade of the Republic of Türkiye, the consumer is required to return the goods within 10 (ten) days from the date on which the withdrawal notification is communicated.
14. Return Shipping Costs
The allocation of return shipping costs for returns made under the right of withdrawal shall be determined in accordance with the provisions of applicable legislation.
Where the Seller has designated a contracted carrier for the return and the Buyer returns the product through such carrier, the consumer shall not be held liable for return shipping costs. This position is consistent with the guidance published by the Ministry of Trade of the Republic of Türkiye.
In the event that the Buyer uses a carrier or shipping method other than the return method communicated by the Seller, any additional costs, delays, loss, or damage risks that may arise shall be subject to further assessment.
Current carrier information, return address, and shipping method applicable to the return process may be communicated by the Seller to the Buyer.
15. Refunds
For products meeting the return conditions, refunds shall be processed within the periods prescribed by applicable legislation.
Upon the valid exercise of the right of withdrawal, the Seller shall refund the product price collected and any other amounts required to be refunded under applicable legislation within 14 (fourteen) days from the date of receipt of the withdrawal notification. In accordance with the guidance published by the Ministry of Trade of the Republic of Türkiye, the seller is obliged to refund the amount paid by the consumer within 14 days following receipt of the withdrawal notification.
Refunds shall be made, insofar as possible, using the same payment method employed by the Buyer at the time of purchase.
In respect of refunds processed to credit cards, debit cards, or other payment instruments, the time required for the refunded amount to be reflected in the account or on the card may vary depending on the processing timelines of the bank, the card issuer, the payment institution, or Shopify Payments.
The Seller shall not be held liable for delays in the reflection of refunds attributable to Shopify Payments, banks, card issuers, or payment institutions.
16. Exchange Requests
BRAGI FORSETI may evaluate exchange requests subject to stock availability and the nature of the product.
Products that are the subject of an exchange request must be unused, undamaged, free from dirt and odours, have their original tags intact, and be in a condition suitable for resale.
In the event that the product requested for exchange is not available in stock, the Buyer may be offered a refund, the option to select an alternative product, or other resolution alternatives.
Exchange requests may be rejected in respect of custom-made products, made-to-measure products, personalised products, or products the return or exchange of which is not appropriate on grounds of hygiene.
17. Defective or Damaged Products
In the event that the product delivered is defective, damaged, incomplete, or not in conformity with the order, the Buyer may contact the Seller to submit a claim.
In the assessment of defective or damaged product claims, the Buyer may be requested to provide photographs, video recordings, a carrier damage report, the order number, or other supporting information and documentation evidencing the condition of the product.
Defective product claims shall be assessed within the scope of Law No. 6502 on the Protection of Consumers and the applicable secondary legislation.
The Buyer's statutory rights in respect of defective products are expressly reserved.
18. Order Cancellation
The Buyer may submit an order cancellation request prior to the dispatch of the order to the carrier.

The cancellation request shall be evaluated provided that the order has not yet been dispatched to the carrier and the product has not entered a custom production, bespoke preparation, or similar process.
Where the order has already been dispatched to the carrier, the process shall be governed by the provisions relating to returns and the right of withdrawal.
Cancellation may not be possible in respect of custom-made, made-to-measure, personalised products, or products prepared in accordance with the Buyer's specific request, where the production or preparation process has already commenced.
19. Cancellation by the Seller
The Seller reserves the right to cancel the order in the following circumstances:
- The product is out of stock;
- There is a manifest and obvious error in the product price;
- There is a system error in the product information;
- The payment transaction cannot be completed;
- The payment is declined by the bank or payment institution;
- There is a suspicion of fraudulent activity, unauthorised payment, fraudulent transaction, or chargeback risk;
- The delivery address is incomplete, incorrect, or unsuitable for delivery;
- International delivery cannot be effected due to the applicable legislation of the destination country, customs regulations, or logistical reasons;
- The website is being misused, or the terms and conditions of promotions or discounts are being violated;
- Force majeure events or circumstances beyond the Seller's reasonable control have arisen.
In the event that the order is cancelled by the Seller, any amount collected shall be refunded to the Buyer in accordance with applicable legislation and the processing timelines of the payment infrastructure.
20. Processing of Personal Data
In the course of delivery, return, exchange, and cancellation processes, the Buyer's personal data — including full name, contact details, order information, delivery details, billing information, payment and refund transaction data, and request or complaint details — may be processed.
Personal data shall be processed for the purposes of managing delivery, shipping, return, exchange, cancellation, refund, customer support, invoicing, accounting, legal compliance, and dispute resolution processes.
Detailed information regarding the processing of personal data is set out in the KVKK Disclosure Notice (Personal Data Protection Law Disclosure Text), the Privacy Policy, and the Cookie Policy published on the website.
21. Amendments to the Policy
BRAGI FORSETI reserves the right to amend this Delivery and Return Policy in line with the operation of the website, product categories, delivery processes, payment infrastructure, carrier arrangements, Shopify infrastructure, legislative changes, or commercial requirements.
The updated version of this Policy shall take effect from the date of its publication on the website.
Buyers are advised to review the current Delivery and Return Policy prior to placing an order.
